§ 1 Scope
These T&C apply to all contracts for translation and interpreting services between BFÜ – Rehab Shehata (hereinafter "Contractor") and the Client.
§ 2 Formation of Contract
(1) The contract is formed upon acceptance of the order by the Contractor.
(2) Acceptance may be in writing, by email or verbally.
(3) The Client is bound by the order for 14 days.
§ 3 Scope of Services
(1) Services are provided according to professional standards and applicable regulations.
(2) Certified translations bear the stamp and signature of the sworn translator.
(3) The scope is defined by the order confirmation.
§ 4 Client Obligations
(1) All required documents must be provided completely and in good time.
(2) The Client must inform the Contractor of any special requirements.
(3) Documents must be legible and complete.
§ 5 Prices and Payment
(1) Prices are based on the current price list or agreed individually.
(2) Generally calculated per standard line (55 keystrokes) of the target text.
(3) Payment is due upon delivery unless otherwise agreed.
(4) Late payment incurs interest at 5 percentage points above the base rate.
§ 6 Delivery
(1) Delivery time is agreed at order acceptance.
(2) Delivery by email, post or personal handover by appointment.
(3) Unforeseeable obstacles extend the delivery time reasonably.
§ 7 Copyright
(1) The translation is a copyright-protected work.
(2) The Client acquires the right of use for the agreed purpose.
(3) Transfer or publication requires the Contractor's consent.
§ 8 Warranty
(1) Professional translation to the best of the Contractor's knowledge is guaranteed.
(2) Obvious defects must be reported immediately upon receipt.
(3) Justified complaints will be rectified.
§ 9 Liability
(1) Liable for intent and gross negligence.
(2) Liability for minor negligence excluded unless essential obligations are breached.
(3) Liability limited to foreseeable, typical contractual damages.
§ 10 Confidentiality
(1) Confidentiality of all information obtained in the course of the assignment is maintained.
(2) This obligation continues after termination of the contract.
§ 11 Final Provisions
(1) German law applies.
(2) Jurisdiction is Hamburg for commercial clients.
(3) Invalid provisions do not affect the validity of remaining provisions.
